These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Fitxone LLC, a Wyoming limited liability company formed in 2025, governing your access to and use of our website, digital fitness programs, nutrition guides, AI coaching chatbot, subscription services, one on one coaching, and all related services (collectively, the "Services").

By purchasing any product, subscribing to a plan, using our AI chatbot, or otherwise accessing our Services, you represent that you are at least 18, possess the legal capacity to enter binding contracts, and accept these Terms in their entirety.

Service Offerings:

• Fit and Focused ($97 One Time): The complete 52 week training and nutrition program, delivered as downloadable phase manuals and related documents, with 12 weeks of FitXone coaching app access included as a founding member bonus.
• Reform ($197/Month founding, then $247/Month): Recurring monthly membership combining Fit and Focused access with weekly coach check ins, feedback, and programme adjustments.
• Executive Lab ($497/Month): Application based private coaching with fully bespoke programming, dedicated coach access, and weekly video calls.
• AI Coaching Assistant: On site AI coach powered by the Anthropic Claude API providing general fitness guidance. Not a medical service.
• Free Assessments: The general assessment and diabetic assessment. used to personalise programme recommendations. Submission of assessment data constitutes consent as described in our Privacy Policy.

Digital products are delivered via email and/or coaching app invitation. For Fit and Focused, Kickstart phase materials and your app setup link arrive minutes after confirmed payment. Delivery to your provided address constitutes fulfillment.

Fit and Focused is a phased pathway delivered in stages according to a published schedule. Your first materials, including the Kickstart phase and the Blueprint, are delivered immediately upon purchase. Additional materials, including the nutrition system and field protocols, are delivered across your first week. Later phases, PowerHour and Consistent Edge, are delivered at week four and week sixteen respectively. Phased delivery is a core feature of the pathway, and access to later materials does not constitute grounds for a refund outside the stated guarantee period.

AI Chatbot Disclaimer: The FitXone AI Coach is a supplementary information tool. It is NOT a licensed healthcare provider and does NOT provide medical advice, diagnoses, or treatment recommendations.

You must obtain written medical clearance from a licensed physician before beginning any FitXone program if you have or suspect any pre existing condition. Stop any exercise causing pain, dizziness, or unusual symptoms immediately.

You hereby fully release, discharge, and covenant not to sue Fitxone LLC, its members, managers, coaches, employees, contractors, affiliates, successors, assigns, and agents from any and all claims, except for gross negligence or intentional misconduct.

Services are provided "AS IS" and "AS AVAILABLE." Our total liability shall not exceed the amount you paid for Services in the twelve (12) months preceding the claim, or USD 100, whichever is greater. We are not liable for indirect, incidental, special, consequential, or punitive damages.

You agree to indemnify, defend, and hold harmless all Released Parties from any claims arising from your breach of these Terms, failure to disclose medical conditions, negligence, unauthorised sharing of our content, or false testimonials.

All payments processed via Stripe. Prices in USD. Current pricing: Fit and Focused $97 One Time during the founding window (includes 12 weeks coaching app access as a founding bonus, with price becoming $197 when the founding window closes); Reform $197/Month founding (becomes $247/Month when the founding window closes), recurring; Executive Lab $497/Month, agreed individually before enrollment. Subscriptions renew until cancelled. cancel anytime, access continues until end of paid period.

7 Day Money Back Guarantee: For Fit and Focused, submit your refund request to support@fitxone.com within 7 days of the date of purchase. The guarantee window runs from the date of purchase and is not extended or reset by phased delivery of later materials. Read the Kickstart phase cover to cover. If it is not for you, one email gets a full refund. One claim per customer.

Other refund exceptions: duplicate charges, non delivery within 24 hours, technical failure on our part. No refunds for change of mind, failure to achieve desired results, partially used subscription periods, or user side technical issues. Chargebacks initiated without first contacting support@fitxone.com constitute material breach.

All content. workout programs, PDFs, nutrition guides, AI assessments, website content, videos, graphics, text, trademarks, logos. remains the exclusive property of Fitxone LLC. Purchase grants you a limited, personal, non exclusive, non transferable licence for personal non commercial use. Sharing, resale, sublicensing, or removal of branding is prohibited.

Stripe (payments), Anthropic (AI chatbot), Cloudflare (hosting), Resend (email), Calendly (scheduling), PT Distinction (coaching app). Each platform's own terms and privacy policies govern your relationship with that platform.

Your use of our Services is subject to our Privacy Policy, incorporated into these Terms by reference.

The FitXone AI Coach is a supplementary information tool only. It may contain errors. We do not warrant the accuracy, completeness, or suitability of any AI generated output. Purchased programs are created and reviewed by experienced fitness professionals with real world coaching backgrounds.

Governed by the laws of the State of Wyoming, USA. Any dispute shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, limited to individual claims only. You waive any right to class, collective, or representative actions. Claims must be brought within one (1) year.

We may terminate or suspend access immediately for material breach, fraudulent payment, harassment, content piracy, materially false health information, or chargebacks without prior contact. Access ceases immediately with no refunds for unused periods.

Fitxone shall not be liable for delays or failures due to natural disasters, pandemics, war, internet or telecom failures, power outages, government actions, or third party service outages.

These Terms, together with our Privacy Policy, constitute the complete agreement. We may modify these Terms with material changes notified via email 30 days before taking effect. If any provision is found invalid, remaining provisions continue in full force. Support: support@fitxone.com.
